BSNYC Friday No Quiz, Just Depression Because I'm Bummed Out And So Should You Be!

Another day, another child killed by an Escalade:


But, you know, it's the victim's fault because she wasn't holding mommy's hand:

The girl was not holding her mother’s hand as they crossed the street near 5th Avenue and 55th St. in Sunset Park around 3:15 p.m., sources said. The little girl drifted into traffic and was crushed by a white Cadillac Escalade, sources said.

So, take a deep breath and say it with me now:


No criminality suspected!

Now, I may be suspicious by nature, but when I see a little girl dying in the street I actually do suspect criminality.  I know, call me crazy, right?  So I looked more closely at the picture:


First of all, the windows on that car are more tinted than Lindsay Lohan's sunglasses, which is illegal in New York City.  Fine, not a smoking gun, but it's a start.  Next, I looked up the license plate number, which is also legible in the photo.  The system only gives you information on parking tickets and red light camera violations, but I found that this particular vehicle had received three tickets for not having a valid inspection:


The most recent of which was issued this past Saturday:


I considered the possibility that maybe I'd looked up the wrong plate, but the system is pretty clear on the fact that these tickets were issued to a white Cadillac.

Okay.  Even though we're talking about a dead child for fuck's sake, let's give the owner the benefit of the doubt.  Let's say after last Saturday's ticket he went and got his car inspected, and so he was operating his car fully legally when he ran over the child.  (You know, apart from the windows.)

No.  Fuck that.  I'm pretty confident that tub of shit Escalade should not have been on the road.  And I don't want to let the driver off the hook here, but I also suspect that if they'd towed the shit tub after that third ticket it would now be sitting in the impound at the Brooklyn Navy Yard and not on top of a dead child.  If someone can't be bothered to get their potentially deadly $60,000 car inspected in two weeks then they shouldn't be allowed to have it.  At the very least, you'd think that a dead child would be more than enough to arouse suspicion of criminality, and that maybe someone would, you know, look into it.  I found this stuff in about 19 seconds while sitting around in my underpants drinking coffee.  What else was he doing wrong?  Are we not even going to investigate the possibility?

I'd love to see a mayor with the balls and/or vulva to admit that if you cracked down on all the assholes with expired inspections, no insurance, suspended licenses, out of state registration to save money when they actually live in New York, and so forth, you'd take a shitload of dangerous drivers off the road.  Three tickets for no inspection?  Tow that shit!  "Oh, boo hoo, it's hard having a car in New York City."  No shit, asshole.  It should be hard, and if you can't hack it then don't drive.  You're asking a lot of the city and its residents to accommodate your car.  You should be creeping around town at 20mph with your valid paperwork on hand at all times, petrified at the idea of making contact with anything.

Sadly, instead, all you need to do is strap on your stupid bumper protector, mash your foot to the floor, and let everyone else clean up after you.  It's actually surprisingly easy to own an operate a car in New York City, even if you do it by the book.  You can park your car for free here, which is insane.  Even if you get a parking ticket a month you're getting the deal of the millennium.  Market rate for real estate in Brooklyn is something like $750 per square foot, so you do the math for what a parking space is worth.  (No, seriously, please do the math, because I can't.)

I have a car.  I've pretty much always had one in New York City.  It's registered and insured--to me, at my current address.  Ironically, the reason I've always had a car is that I'm a cyclist, and I wanted to be able to get myself to races.  (Bike racing makes you do really dumb stuff, like shave your legs, spend stupid amounts of money on crabon, and own a car in New York City.)  Also, like many bike dorks, I like operating vehicles with wheels, and I actually enjoy driving.  (You know, open road driving, not city driving.)  Therefore, I like to be engaged in the act of driving while I'm doing it.  My car has a manual transmission.  It has four doors and a hatch, but it's small (miniscule by American standards), and it's pretty low to the ground.  If I go over a bump I feel it.  The engine is small (miniscule by American standards), but with a manual you can work the motor hard when you need to, and anyway, any car that can carry three cars on the roof at highway speed and still have a little left over is more than enough power in my Haggadah.

On my recent vacation to Mt. Tampon, I rented a car, because you can't really get around there without one.  The car was what is called a "compact crossover."  Yeah, "compact" my balls.  (Actually, please don't compact my balls.)  I was sitting higher than I would have been on the roof of my own car, which made anything happening in the immediate vicinity of the vehicle ambiguous at best.  The windows had a slight tint to them which made me feel like I was driving stoned or wearing sunglasses at dusk.  Besides that, the stupid shape of the windows made visibility poor, and I really couldn't see out of the rear window at all.  Hence, the car came equipped with a backup camera system.  Holy shit, is that weird and annoying!  Forget being detached from the driving experience--it's like wiping your ass with a series of levers and pulleys.  (Or an "aubesian"--which, come to think of it, would make a great model name for a "compact crossover.")

Seems to me you should need to get a special license for any vehicle that requires using a fucking camera to operate.

Anyway, I fucking hated this car.  I especially hated it the couple of times I had to drive it into the city when I had to drive this stupid loaf with its poor visibility through intersections and crosswalks.  It was like walking around in a fat suit.  And then I look at that white tub of shit, which could easily drive over my rented "compact crossover," and all I can think is no fucking way.  Giant trucks driven recreationally without inspections in the second-most populated county in America?  (That's Brooklyn.)

Yeah, no shit people are getting killed.

In any case, sure, I guess I'm part of the problem with my car and my free parking and all the rest of it (uh, my car's OK, but any car bigger than mine is BAD!), but you have to wonder when, how, or if people are ever going to refuse to accept that it's okay to kill people here with a car.  Even I didn't think about it that much before starting this blog.  Hey, a story like this may ruin your day, but at least it didn't ruin your life.  (Yet.)

it's awful. A cyclist was killed in Boston in the not too distant past and the driver of the truck that killed him was recently cleared of all charges... even though he "right-hooked" (against the law in MA) the cyclist (who was traveling in a bike lane). What the actual fuck.

Holding drivers accountable for the consequences of driving like they're a NASCAR stud on city streets is too much to ask. Jailing scumbag drivers who kill kids could really hurt their self-esteem, and we wouldn't want them to feel badly about themselves. Prosecuting homicidal drivers also sounds like work, which should also be avoided. I suppose the driver feels bad enough they just snuffed a kid; the cops should give them a trophy to cheer them up. (Everybody gets trophies these days.) Sadly, not much will change until a Times reporter's kid gets hit.

I plowed into a little girl on my residential street a few weeks ago. She ran out between two parked cars and I couldn't stop in time. We both fell down and then walked away afterward with some scrapes and bruises. I feel like if a cop was around I would've gotten in so much trouble because I was on a bike. And then I see people going 35 down the street in a car. This sucks. I don't want some little girl to be dead in front of my house.

And the net worth of the jerk is probably one tub of white Caddy that has been poorly maintained at that. Once that's gone, nothing left for the family but anger. And when you look at the stats for married folks that loose a child to death, most likely the family is headed for divorce. Fun times all around!

wow dude, accusing a person of murder or maybe just negligent homicide because you don't like thier choice of vehicle. Nice. Seems like a horrible fucking accident to me also, but maybe there a chance it was just that regardless of the type of car the person was driving. Also a failed inspection sticker isn't actually tantamount to vehicular manslaughter. If it were speeding or running red lights you could make a connection to reckless driving.

Also, "dude," it's a SAFETY INSPECTION. It's not a random sticker they make you put on a windshield for no reason, like a fucking spoke card. I'm not calling him a murderer but I am saying when some driving a huge truck that has failed or never had a SAFETY INSPECTION and a CHILD DIES then that warrants more than "No criminality suspected, try not to hit anyone else on the way home."

I don't know the specifics of this case and the driver involved, but I've noticed that a contributing issue is the people who move with their cars to New York from a more suburban area.

They've spent their whole adult driving lives not having to worry about pedestrians as something they have to look out for. This is of course because the only pedestrian-ing that happens in suburbs is the aforementioned waddle to and from the behemoth douche-mobile for what is often the 1 and a half mile round trip drive to the WaWa to pick up a 2 liter bottle of Diet Coke.

Really the only time that a suburban driver needs to be aware of pedestrians is when they're in the parking lot of the shopping mall when they're crawling along at 5 MPH looking for that magic parking spot that will minimize their waddling to the absolute minimum.

Of course the petro-automotive-feedbag complex has billions invested in the propagation of this whole system.

We are so screwed.

I walk through parking lots with a death-grip on my kids b/c most of the idiots around here seem to think those isles between parked cars are a place to live out their NASCAR dreams.

What a fucking horrible heartbreak. There should be standard operating procedure that the police go by in these situations (by "these situations" I mean, where someone is mowed down while crossing the street or walking along a sidewalk.
1. Check for vehicle for safety violations.
2. Check the driver for drugs/alcohol. Yes, that means blood test: sorry it's a hassle but it is not "unreasonable search" after a fatal accident.
3. Check cell phone records to see if person was violating the law by talking or texting at time of accident.
4. And probably some other shit that I'm not thinking of right now.

Seriously. Even if we're too fucked up a society in supposedly liberal New York City where less than 50% of households own a car --- even if we're too fucked up to criminalize running people over, we should at least make the act of doing so more inconvenient.

Wildcat dude machine, I understand what you are saying or maybe not. All I'm saying is that a safety inspection has nothing to do with reckless driving. If you're trying to build some kind of link to tie this driver of an unagreeable car car to killing a child that seems a little bit of a stretch to me. It's sort of similar to blaming a injured cyclist for not wearing a helmet - "how could anyone be so reckless!" And spare me the righteous indignation of how could i possibly compare the death of a child to the helmet debate! It's an analogy. Are there a shit load of aggressive and stupid drivers on the street, absolutely. Do the cops do enough to discourage and punish such behavior, fuck no. Should this guy who might be completely innocent of any wrong doing, in this particular accident, be strung up by his/her balls/similar girl parts without due process to make this point. Is failing to get an inspection sticker on your car a reason to suspect someone of reckless driving. No. Should the cops investigate the case to make sure this person was not driving recklessly. Definitely. Should they go on record saying that criminality is suspected, without any evidence whatsover. Apparently so.

What don't you understand? The car, regardless of make, should not have been on the road if it had not passed a SAFETY INSPECTION. Furthermore, not keeping a car's inspection current is indicative an irresponsible vehicle owner. When you don't use a vehicle responsibly the upshot is people get hurt or killed. String him up? Deprive him of due process? No. However, THERE SHOULD BE A FUCKING PROCESS IN THE FIRST PLACE.

If you can't keep your car roadworthy and safe, whether it's an Escalade or a Fiesta, you shouldn't have it.

Every time I see one of those Escalades, I think "Are you really that big of an asshole that you need an Escalade? A GMC Yukon wasn't asshole enough for you?" I feel basically the same way about the Porsche Cayenne. People with one or more of lots of money, limited intelligence, or inadequacy issues should be required to drive extremely small cars. Or better yet, they should be required to ride a bike, take public transportation, or, heaven forbid, walk.

I'm sure WRM is proud of himself for his little Escalade investigation, but he should ask himself: could he have done that while shoving donuts into his face with one hand and pepper-spraying a demonstrator with the other?

Until you know what cops really have to deal with on the job, you should be more understanding of ""no criminality suspected".

P.S. With an NYPD largely staffed by car commuters from the suburbs, when a cop sees a scene like that, whom do you think they identify more with: the driver, or the family on foot? Any chance that affects how such an incident is handled?

I've never felt seriously concerned for my own safety while biking, but that reflects my own recklessness more than my actual surroundings. Still, I wonder in the back of my head why it is possible that 2-3 times, twice a day, on my way too and from work, some doofus in a car tries his/her hardest to kill me.
Since I recently moved from Illinois to California, I was required to get a new license, even though my old one didn't expire for another year.
While at the DMV yesterday, the constant attempts at my vehicular manslaughter that are par for the course here in CA (and were existent, but slightly less common in IL) made perfect sense.
The bar for getting a drivers' license is so low that I'm not sure it exists. I was not required to take a driving test, so I did not witness that hoop to jump through, but I saw plenty of elderly people who needed instructions shouted at them, and were dragged by the wrist to stand on the x to have their license picture taken. There were also troubling communication breakdowns I witnessed which I am still trying to reconcile without coming off as a terrible 'speak american' xenophobe.
Anyways, a drivers' license should be more difficult to obtain and retain.

I have a longish walk between the subway and my office on the far east side, which requires crossing several avenues. Which I do, when I have the signal, in the crosswalk. Still, almost every day, more than once, some asshole comes tear-assing around the corner when the light turns green, headed right at me or other pedestrians, or curves a few feet around me at a high rate of speed, then races up to the red light 20 meters away. It happens every day. Drivers accelerating wildly at jaywalking pedestrians (on, like, 68th street) when there's a red light just up ahead. Drivers in NYC are dicks. It's no surprise so many people get hit.

there are reckless drivers everywhere. It is just magnified in NYC given the crowded streets and hectic pace of life here. The sad fact is that many people do really stupid, dangerous and irresponsible things without thinking of the consequences because they are selfish. This is one of the many dark sides to human nature, which isn't confined solely to NYC drivers.

Bike snob, let's agree to disagree. But I have received a ticket for failing to get an inspection sticker. I rarely use my car and forgot that it was due for inspection and as you know the NYC cops love writing tickets, so I got one. As a daily bike commuter in NYC for the past 20 years I'm also a very careful driver, notwithstanding this non-moving violation. So I guess i was giving the driver the initial benefit of the doubt. I wasn't suggesting the cops shouldn't investigate this case thoroughly. Of course they should, a person was killed and in this case, tragically, a child. I was just saying that letting your inspection sticker lapse isn't evidence of reckless driving, more just sloppy administration. I do agree that huge SUVs are stupid and have more blind sides and cause more damage by there massive size but unfortunately they are legal.

To be fair, I don't see any information in that article to indicate it didn't go down similar to PTD's 12:43 story. If my reading skills are lacking, please correct me. How much time did the driver have to react? Like you've said before Snob, idiots walk, ride bikes and drive cars. If the Escalade was running a red light, then nail him to the wall. If he would have had time to stop if he wasn't speeding/texting/wanking, or his vehicle wasn't in proper working order then ditto. It's fun to pick on Escalades, but then some think it's fun to pick on bikes. Easy targets of prejudice. Keep us posted on the details.

Doesn't sound like just the victim by herself to me. Sounds more like a car bearing down on a family crossing the street. Were they crossing against the light? Was the driver doing the old "roll through the light that turned red three seconds ago" thing? Don't know, but I'd like to live in a place where I was confident they were investigating.

Agreed completely on all points, except this one: "the second-most populated county in America". Brooklyn (Kings County) is the eighth-most populated county in the country; Cook County, IL (Chicago) is second. Los Angeles County is first.

Brooklyn is indeed the second-densest county, after Manhattan. Some of those counties are freakin' huge; LA County is almost as big as Delaware.

I read this earlier, got depressed, didn't comment, rode to the grocery instead. It's a beautiful day here but I was still bummed when I got back (also I woke up with what feels like a cold and called in sick, so that's not helping...). I can't understand why the police would say anything other than "we're investigating" when someone is killed. "No criminality suspected" just sounds like "sorry about your kid, have a nice day." Nothing should be called an accident when a car is involved. First car "accident" I ever had wouldn't have happened if the guy I rear-ended had had working lights and I hadn't been talking to people in my car. Neither of us was ticketed, and police and insurance considered it an accident, but no. Two people fucked up in small ways and 6 people were lucky to walk away with minor injuries. Gah. Anyway, thanks for the Robin Williams link, that was good. And a big hello to BGW, good to see you around these parts again!

Now, I'm no law talking guy, but in my books driving a vehicle that you neglected to have safety inspected IS reckless driving.

Recklessness is not giving a fuck. If you don't give enough of a fuck to get your vehicle safety inspected when it is due, for whatever reason, and then you drive that vehicle you are driving it recklessly. Sorry Anon 2:59 but if letting your inspection sticker lapse (oopsie - you do realise it's not just about the pretty sticker?) is just "sloppy administration" then speeding is just "sloppy administration of the gas pedal" and running a red light is just "sloppy administration of your own will to conform to the rules designed to avoid you killing people, rules you agreed to when you signed the contract that is your licence to drive"

But having said all that, I'm a dodgy prick at times so I can't really talk.

The vehicle in the picture has tinted taillights. Just how stupid is the driver? Stupid enough to be dangerous? Empirical evidence suggests that's true.

Anon 11:12, at my work we are supposed to conduct a risk assessment prior to undertaking any task. A risk rating is determined by estimating the probability of an incident occurring and the severity of the consequences - I imagine it is a pretty standard practice in many industries. Anyway, in summer we get winched out of helicopters into remote and rugged terrain to direct attack wildfires with hand tools and chainsaws. Driving on public roads consistently rates as our highest risk activity.

ugh i hate this comment. i spend 60 hours a week in the saddle in manhattan. consequently i see a lot of commuting, foot, bike and internal combustible engine. these experiences have eventually led me to the conclusion that you have to be responsible for yourself. if you focus hard enough you can possess awareness of what going on around you 360. that being said there is always the random (see cab on sidewalk, pretty italian girl with half leg incident) that cannot be avoided. my biggest fear is improperly secured air conditioners falling out of windows and crushing my brain to death because up is the one place i cant look. for anyone who wants some extra anxiety/paranoia look up for a second anywhere in manhattan and you will see hundreds of 30 pound death missiles propped up with 2x4's and chicken wire. point being you can't have the city regulate every aspect of your life in order to achieve safety. bicycling in nyc was a somewhat underground activity for 30 years and the consequences of that status were both good and bad. the good being that you could do whatever the hell you wanted and get from the LES to UWS in 15 minutes if you had the engine and the skills. you still can in fact. the bad being that you were totally on your own in terms of safety. now we have bicycling in the full spotlight of mainstream nyc, bicycling lanes, citi bikes, more commuters, rise of fixi culture ad. infinitum and i'm worried that cyclists are being lulled into a false sense of security while simultaneously being subjected to more "negative attention" by police i.e. tickets and vastly enhanced feeling of animosity from the NYPD towards all cyclists. i don't want more "safety" legislation, i don't want more bike lanes and i don't want the US vs THEM mentality to be increasingly propagated by the cycling community "whatever that is" if you ride in nyc take responsibility for your own safety, you can do it, but also be honest about your skill level and the abilities of those around you. my wife had been on two wheels for 25 years and i don't let her ride on the street without me. not because she's stupid or unskilled but because i know the opportunities for disaster and consequently ride hyper aware in an effort to avoid them. cabs, delivery trucks and even SUV's can be handled under normal circumstances and even utilized for safety. i'm losing the thread here but maybe everyone should focus more on their own safety and skills and forgo the false belief that any amount of laws or lanes or prosecutions are going to save you. please ride safe everyone and watch out for those fucking window air conditioners!!!!!!!!!!!!!

Chiming in to echo MW's comment about drivers unused to dealing with pedestrians, though that doesn't necessarily seem to have been the case here. Camping at a state park near Houston a couple of years ago, I was struck by the fact that everyone else in our little loop of cabins consistently got in their cars and DROVE to the communal bathroom, maybe 200 yards away from the furthest cabin? And I think they're just conditioned that way, because in suburban Houston, you'd be crazy to walk more than 30 feet from your front door without donning at least 3500 pounds of metal armor.

I also think the number of doughnut shops per capita in Tomball, particularly, might set some kind of record.

I have used pedestrians as human shields against SUVs. I have used SUVs as shields against pedestrians.

I also get the hyper-awareness thing, but he failed to mention something that's much more pertinent than falling air conditioners: road conditions. Hitting an undetected deep pothole or rut at certain speeds will crush your brain just as easily as a falling A/C unit once your front wheel finds it before your eyes do.
